Namit Sharma v/s Union of India

Right to Information Act 2005 is related to Namita Sharma v/s Union of India. Right to Information Act 2006 mandates timely response to citizen requests for government information. The basic object of the Right to Information Act is to empower the citizens, promote transparency and accountability in the working of the Government, contain corruption, and make our democracy work for the people in real sense. This Act is a big step towards making the citizens informed about the activities of the Government.

The Supreme court judgement in the case of Namit Sharma vs. Union of India has brought the whole RTI mechanism in the country to a standstill.
The writ petition question the constitutional validity of section 12(5), 12(6) and 15 (5), 15 (6) of the RTI Act, 2005 which deal with the prerequisites for an Information Commissioner at Center and State Information Commissions respectively.
