    Habeas Corpus

    Harbeas Corpus writs can be issued by a High Court to secure liberty of the individual. The meas of corpus is “You many have the body”. The concept of writ of habeas corpus has originated from England. This writ is issued in order to protect individual liberties.

    According to the India Constitution Article 32 (2) ‘The Supreme Court shall have power to issue directions or orders or writs, including writs in the nature of habeas corpus, mandamus, prohibition, quo warranto and certiorari, whichever may be appropriate, for the enforcement of any of the rights conferred by this part.’
